It is reported that the “provisions” have been adopted at the fourth meeting of the Standing Committee of the 10th Zhuhai Municipal People’s Congress on April 29 this year and will come into force on June 1. This is the first time that Zhuhai has implemented legislative control over industrial control lines. This regulation is also the first local regulation in China to specifically regulate industrial land control lines.

Innovation carries out accurate division with “plot”
“The driving force of Zhuhai’s economic development lies in the industry, the potential lies in the industry, and the breakthrough also lies in the industry. Focusing on the strategic objectives of “industry first, transportation improvement, urban leapfrogging and people’s livelihood”, Zhuhai has put the protection of industrial land on the agenda. At the beginning of this year, the Standing Committee of Zhuhai Municipal People’s Congress set up a special research group to carry out research on the protection of land for industrial development. The survey found that there are many problems in the preparation and use of industrial land in Zhuhai, such as the small total amount of land, the low efficiency of land output, the prominent expectation of land use change, the imperfect exit mechanism of industrial land, and the lagging supporting facilities in the park, which lead to the limited space for industrial development and urgently need to be regulated from the system. In view of this, the Standing Committee of Zhuhai Municipal People’s Congress timely included the “Regulations on the management of industrial land control lines in Zhuhai Special Economic Zone” in the 2022 legislative plan.
As a reform exploration, Zhuhai compared the relevant domestic regulations in the legislative process. In 2018, the people’s Government of Guangdong Province proposed in the “several policies and measures to reduce the cost of manufacturing enterprises in Guangdong Province and support the development of the real economy (Revised)” that “all regions and cities should set up industrial land control lines to fully ensure the supply of industrial land. Since 2018, cities in the province (Guangzhou, Shenzhen, Dongguan and Huizhou) have explored the protection line of industrial land, and implemented hierarchical control over industrial land. It has successively issued normative documents such as the measures for the administration of industrial block lines in Shenzhen, the measures for the administration of urban brown lines in Foshan, the measures for the administration of industrial protection lines in Dongguan, and the measures for the administration of industrial blocks in Guangzhou. These provide a reference for Zhuhai to establish an industrial control line management system.
On the basis of summing up the experience of other cities, Zhuhai has implemented different delimitation methods in the management of industrial control lines, which is different from the delimitation mode of surrounding cities by regionalization. It innovatively proposes to combine planning and ownership, and accurately implement it to specific plots. All industrial land that has been used for industrial purposes over the years and the planned new industrial land in the future, except for the land reserved by the village collective, are included in the industrial land control line. Among them, the secondary line includes the primary line. The first line is pure industrial land, and the second line includes industrial land and land supporting industry.

On the one hand, the scope is more accurate. This time, the industrial control line is defined by combining planning and ownership, which is accurately implemented to the coordinates of specific plots, and can more effectively control the industrial plots. On the other hand, the original owners are strictly restricted from changing the function of industrial land. If the land within the industrial control line needs to be adjusted to a business function, it must be collected and stored by the government before it can be transferred out and sold again , the original owners are no longer allowed to change their functions by themselves, which will further eliminate the idea of hoarding land for transformation, greatly reduce the expectation of speculation in industrial land, and help stabilize the total scale of industrial land in Zhuhai and support the development of the real economy. ”
Scientifically manage and control land resources with institutional rigidity
According to the introduction, this legislation is to use the legislative power of the Special Economic Zone in Zhuhai to establish an industrial land protection line system to scientifically control land resources with institutional rigidity. Adhere to the problem orientation, aiming at ensuring the space for industrial development and promoting high-quality industrial development, and provide institutional basis for the protection of industrial land in Zhuhai. There are 20 regulations in total, regardless of chapter. The main contents include the concept, nature, management principles, total amount and scale of industrial land control line, delimitation procedures and adjustment conditions, supervision and management, legal responsibilities, etc.
According to the regulations, the industrial land control line is an integral part of the overall land and space planning of Zhuhai and the basis for the planning, construction and management of industrial land in Zhuhai. The management of industrial land control line should follow the principles of total amount control, strict adherence to the bottom line, classification and decision-making, quality improvement and efficiency increase.
The regulations specify that the total land area within the industrial land control line of Zhuhai shall not be less than 30% of the total construction land area of the city, of which the industrial land area shall not be less than 75% of the total land area within the industrial land control line. The above proportion was determined on the basis of fully listening to the opinions of the municipal government and its relevant functional departments, deputies to the National People’s Congress and the public, combined with the actual situation of Zhuhai, and based on the demand for industrial land with the total industrial output value exceeding the target of 1trillion yuan during the “14th five year plan” period. After the industrial control line is delimited and announced by the municipal government, it will be strictly implemented as a plan.
The regulations strictly stipulate the delimitation and adjustment conditions of the control line of industrial land, and endow the government with a certain degree of adjustment autonomy. The regulations stipulate that the delimitation, adjustment and revision of the control line of industrial land must follow certain procedures: clarify the delimitation procedures to ensure the scientificity of the delimitation of the control line of industrial land; Clearly stipulate the adjustment conditions, and stipulate that the adjustment of the primary control line should achieve the balance between the total scale and the compensation, and improve the quality of land use, so as to ensure that the industrial land within the primary control line is not reduced and the quality is not reduced; The regulations allow the municipal government to conduct an overall evaluation and revision of the city’s industrial land control line every five years, and authorize the Zhuhai municipal government to formulate specific measures for the adjustment of industrial land control line, aiming to meet the actual needs of different development stages and give the government a certain degree of adjustment power.
In view of the lag in the construction of supporting facilities in the park, the regulations stipulate that the land within the secondary control line and outside the primary control line should give priority to the supporting public services, municipal public utilities, environmental protection and road traffic facilities of the industrial park, as well as the land for green space and squares. The regulations exclude indemnificatory rental housing from supporting projects, and systematically prevent the possibility of “real estate” of industrial supporting projects.
In addition, the regulations clearly stipulate the responsibilities of the municipal government, its functional departments and district governments, requiring the supervision and management of the construction and use activities of land within the industrial land control line, and the supervision and inspection of the implementation of each district every year; The Zhuhai Municipal Department of natural resources is required to establish and maintain the database of industrial land control lines, and the Municipal Department of industry and information technology is required to establish an information-based supervision platform for industrial projects, so as to realize the dynamic management of land use control and industrial development. The regulations specifically stipulate the disposal system of inefficient land, clearly list six types of inefficient land, and authorize the Zhuhai municipal government to formulate specific identification standards and disposal methods for inefficient industrial land, and strengthen the supervision of inefficient industrial land.
